Punishments for Felony Convictions in Texas
Pursuant to Chapter 12 of the Texas Penal Code, offenses are designated as misdemeanors or felonies. Misdemeanors are punishable by a fine and confinement in state jail for up to one year. Felonies are classified into five distinct groups:
- State Jail Felony. Punishable by a state jail term of not more than two years and a fine not to exceed $10,000.
- Third-Degree Felony. Punishable by imprisonment in the Texas Department of Criminal Justice for up to ten years and a fine not to exceed $10,000.
- Second-Degree Felony. Punishable by imprisonment for up to twenty years and a fine not to exceed $10,000.
- First-Degree Felony. Punishable by “imprisonment in the Texas Department of Criminal Justice for life or any term of not more than 99 years or less than 5 years” and a fine not to exceed $10,000.
- Capital Felony. Punishable by life in prison without the eligibility of parole or death.
