High Quantity

Schedule II drugs (cocaine, Fentanyl, methamphetamine, PCP, etc.)

  • First offense: not less than five years and not more than 40 years, fines up to $1 million.
  • Second offense: Not less than ten years, up to life imprisonment, fines up to $8 million

Any Quantity Schedule I and II Drugs

  • First offense: Up to 20 years, and $1 million in fines
  • Second offense: Up to 30 years, and $2 million in fines

Any Quantity Schedule III Drugs

  • First offense: Up to 10 years, fines up to $500,000
  • Second offense: Up to 20 years, fines up to $1 million

Any Quantity Schedule IV Drugs

  • First offense: Up to five years, fines up to $250,000
  • Second offense: Up to 10 years, fines up to $500,000

Federal Marijuana Trafficking Penalties
